هل يستطيع الأجنبى المقيم فى مصر أن ياخد إقامة على العقار الذى يمتلكه داخل مصر ؟
ماهى شروط الإقامة العقارية داخل مصر ؟
لابد أن نعلم أن القانون المصرى حدد بعض الشروط حتى يستطيع الأجنبى المقيم فى مصر أن يحصل على الاقامة العقارية و التى من أهمها :
بالنسبة للوحدات السكنية منتهية الإنشاء: تمنح الإقامة طبقاً لقرار وزير الداخلية والقانون رقم 230 الصادر سنة 1996.
أما بالنسبة للوحدات السكنية تحت الإنشاء، يشترط الآتي:
ان يشترى عقاراً بقيمة 100 ألف دولار أمريكى أو ما يعادله بالمصرى يمكنه الحصول على إقامة لمدة سنة ولمدة ثلاث سنوات قابلة للتجديد.
1- من يمتلك عقاراً أو أكثر بقيمة لا تقل عن 200 ألف دولار أمريكى أو ما يعادله بالمصرى.
2- وفى حال كانت قيمة العقار 400 ألف دولار أمريكى او ما يعادله بالمصرى تكون الإقامة خمس سنوات.
3- أن يكون سند ملكية العقار مسجل بالشهر العقارى «فى سوريا يسمى طابو».
4- وأن يتم تقديم ما يثبت تحويل مبلغ الشراء عبر أى بنك معتمد فى مصر.
5- وتمنح لمالك العقار وأقاربه من الدرجة الأولى.
• ولابد من تقديم العقد الابتدائي الموقع بين المشتري الأجنبي والمالك مختومة من هيئة التنمية السياحية – هيئة المجتمعات العمرانية الجديدة – المحافظات.
• تقديم خطاب من الجهة صاحبة الولاية.
• تقديم بيان بأن الوحدة تحت الإنشاء موضحاً موعد الإستلام.
• لا يزيد موعد الإستلام عن 4 سنوات.
• تقديم خطاب من بنك المالك ببيان تحويل المبلغ من الخارج.
• تقديم خطاب من بنك المشتري ببيان بمبلغ التحويل بالدولار والمقابل له بالجنيه المصري لغرض شراء الوحدة السكنية الموضحة في العقد الإبتدائي.
• يتم إعداد نموذج موحد يتضمن (عنوان العقار – رقم العقار – اسم المالك – الجنسية) وتسليمه لمصلحة الجوازات والهجرة.
• يتم عمل 3 نماذج موحدة للإجراءات (من البنوك لإدارة الجوازات – من جهة الولاية لإدارة الجوازات – من المالك لإدارة الجوازات حين تجديد الإقامة).

What are the conditions for real estate residence in Egypt?
We must know that the Egyptian law has set some conditions so that a foreigner residing in Egypt can obtain a real estate residence, the most important of which are:
For finished housing units: Residence is granted in accordance with the decision of the Minister of Interior and Law No. 230 issued in 1996.
As for the residential units under construction, the following are required:
If he buys a real estate worth 100,000 US dollars or its equivalent in Egyptians, he can obtain a residence permit for a period of one year and for a period of three years, subject to renewal.
1- Whoever owns one or more real estate with a value of no less than 200 thousand US dollars or its equivalent in Egypt.
2- If the value of the property is 400,000 US dollars or its equivalent in Egypt, the residency will be five years.
3- The property title deed must be registered in the real estate registry “in Syria, it is called Tapu”.
4- A proof of transfer of the purchase amount must be submitted through any approved bank in Egypt.
5- It is granted to the property owner and his first degree relatives.
• The initial contract signed between the foreign buyer and the owner must be submitted, sealed by the Tourism Development Authority - the New Urban Communities Authority - the governorates.
• Submit a letter from the authority with the mandate.
• Submit a statement that the unit is under construction, indicating the date of receipt.
• The date of receipt does not exceed 4 years.
• Submit a letter from the owner's bank stating the transfer of the amount from abroad.
• Submit a letter from the buyer's bank stating the transfer amount in dollars and the equivalent in Egyptian pounds for the purpose of purchasing the housing unit shown in the initial contract.
• A unified form is prepared that includes (property address - property number - owner name - nationality) and handed over to the Passports and Immigration Department.
• 3 unified forms of procedures are made (from the banks to the Passport Department - from the state authority to the Passport Department - from the owner to the Passport Department when renewing the residence).
