هل يحق لأبناء الام المصرية من زوج أجنبي الحصول على الجنسية المصرية ؟

 

شروط الحصول على الجنسية المصرية لأبناء الام المصرية :

حيث اشترط المشرع لكل من وُلد لأم مصرية وأب غير مصري قبل 15 / 7 / 2004 -

تاريخ العمل بالقانون رقم 154 لسنة 2004-

الحق في أن يعلن وزير الداخلية برغبته في التمتع بالجنسية المصرية، ويعتبر مصريا بصدور قرار بذلك من وزير الداخلية، أو بانقضاء سنة من تاريخ إعلانه دون صـدور قرار مسبب منه بالرفض، أما أولاد الأم المصرية زوجة الأجنبي

من مواليد 15 / 7 / 2004 وما بعدها فيحملون الجنسية المصرية بقوة القانون .

ملاحظات هامة :

يتم اكتساب الجنسية المصرية داخل جمهورية مصر العربية عن طريقين أولهما :

تقديم طلب إلى مصلحة الجوازات و الهجرة و الجنسية

و ذلك لاكتساب الجنسية المصرية

ثانيها : يتم اللجوء إلى القضاء للحكم باكتساب الجنسية المصرية و ذلك عند توافر الشروط التى حددها القانون

و يترتب على اكتساب الجنسية المصرية و منحها لأبناء الام المصرية المتزوجة من اجنبى و بعد صدور قرار المنح يخطر قطاع الأحوال المدنية لاستخراج شهادة ميـلاد مصـرية وبطاقة رقم قومي مصري .كما يتم إخطار إدارة التجنيد للحصول على إعفاء من أداء الخدمة تنفيذ القرار السيد وزير الدفـاع رقم 280 لسنة 1986 الخــاص باستثناء مزدوجي الجنـسية من أداء الخدمة العسكرية، ويمكن صرف جواز سفر مصري في حالة طلبه.

- كما يجوز لصاحب الشأن طلب اكتساب جنسية الأم المصرية بقوة القانون بمرور مدة عام من تاريخ تقديم الطلب مالم يصدر قرار مسبببا لرفض من السيد وزير الداخلية.

و في حالة إذا كانت الأم المصرية قد توفيت فمن حق ابنها أن يتقدم بطلب لإدارة الجنسية بمصلحة الجوازات والهجرة يفيد رغبته في الحصول علي الجنسية المصرية ويرفق مع الطلب كل الأوراق اللازمة مضافا إليها شهادة وفاة الأم وبعدها يكتسب الجنسية المصرية ويحصل علي شهادة ميلاد مصرية وبطاقة رقم قومي تحمل العنوان الذي يقيم فيه في مصر بشرط أن تؤكد تحريات المباحث إقامته في هذا العنوان

Conditions for obtaining Egyptian citizenship for children of an Egyptian mother:

Where the legislator stipulated that everyone who was born to an Egyptian mother and a non-Egyptian father before 7/15/2004 -

Effective date of Law No. 154 of 2004-

The right to announce to the Minister of Interior his desire to enjoy the Egyptian nationality, and he is considered an Egyptian by the issuance of a decision to that effect by the Minister of the Interior, or by the lapse of one year from the date of his announcement without a reasoned decision being issued by him to refuse. As for the children of the Egyptian mother, the foreigner’s wife

Born on 15/7/2004 onwards, they hold Egyptian citizenship by force of law.

Important Notes :

Egyptian citizenship is acquired within the Arab Republic of Egypt through two ways, the first of which is:

Submit a request to the Passports, Immigration and Nationality Department

This is for acquiring Egyptian citizenship

Second: The judiciary is resorted to to rule on the acquisition of Egyptian nationality, when the conditions set by the law are met

The result of acquiring the Egyptian nationality and granting it to the children of the Egyptian mother married to a foreigner. After the granting decision is issued, the Civil Status Sector is notified to obtain an Egyptian birth certificate and an Egyptian national number card. The Recruitment Department is also notified to obtain an exemption from service performance. Implementation of the decision Mr. Minister of Defense No. 280 For the year 1986, which excludes dual nationals from performing military service, and an Egyptian passport can be issued if requested.

The person concerned may also request the acquisition of the nationality of the Egyptian mother by the force of law by the lapse of one year from the date of submitting the application, unless a decision is issued that causes a refusal by the Minister of Interior.

And in the event that the Egyptian mother has passed away, her son has the right to submit an application to the Nationality Department at the Passports and Immigration Department stating his desire to obtain the Egyptian nationality. All the necessary documents shall be attached to the application in addition to the mother’s death certificate, after which he acquires the Egyptian nationality and obtains an Egyptian birth certificate and a national number card. It bears the address at which he resides in Egypt, provided that the investigations of the investigations confirm his residency at this address
